The total aggregate liability of Bella Vonte and its affiliates, arising from or in connection with these Terms, shall in no event exceed the greater of one thousand dollars or the actual amount remitted to us by the client in question. Please be advised, however, that certain jurisdictions may not permit such limitations on damages, in which case additional rights may be available to you under applicable law.

DISPUTES

BETWEEN YOU (THE CLIENT) & US

By engaging with our site, you expressly waive any right to a trial by jury, as well as the right to litigate any matter arising from these Terms or our services in a court of law. Any concerns, disputes, or claims between you and Bella Vonte shall first be addressed through good-faith negotiations, with both parties afforded up to ninety (90) days to reach an amicable resolution. Should a resolution not be achieved within this timeframe, the matter shall be submitted to binding arbitration, conducted exclusively on an individual bases. At no point shall a judge or jury preside over or decide such matters.

In the event of a dispute between you (the Client) and Bella Vonte, along with its associates, you agree to initiate resolution by contacting us through the designated link below. Subsequent correspondence will be conducted via email, with both parties endeavoring to resolve the matter within ninety (90) days. If no resolution is reached, binding arbitration shall serve as the final method of settlement.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Bella Vonte, its associates, and its partners from and against any penalties, liabilities, losses, damages, investigations, legal actions, or costs of any nature, arising from third-party claims resulting from your breach of these Terms, your submissions to us, or any fraudulent or unlawful actions. Furthermore, you agree not to settle any claims pertaining to Bella Vonte without our prior written consent, with Bella Vonte retaining sole discretion in determining the appropriate course of resolution.
